Tax Residency of Individuals – Looking Beyond Time Spent in Australia
The cornerstone to determining an individual’s taxable income and then how they will be taxed is their individual tax residency. Increased globalisation has increased economic opportunities and mobilised the workforce. However, this also means determining whether someone is a resident, non-resident or temporary resident can be difficult, particularly where they have ties to more than one country. Australian residency rules for individuals are largely subjective and based on an individual’s facts and connection to Australia. It requires tax advisors to consider not only the current facts but also the circumstances of an individual in the surrounding income years as evidence to support a residency status conclusion.
